Attorney Jason Greaves, who acknowledged the error, explained that he turned to the AI tool due to tight deadlines while preparing a motion related to a subpoena dispute involving Federal Emergency Management Agency (FEMA) layoffs. His reliance on this technology has underscored the risks of AI hallucinations, where the system produces misleading or completely false information.
In a declaration filed on May 6, Greaves expressed regret over including the unreliable quotes. "Given the tight time constraints I used an enterprise level, data-isolated AI platform, Claude Console, to create an initial draft of the motion. That was a mistake," he stated. He noted that he had instructed an associate attorney to verify the citations, but the verification process failed to catch the inaccuracies.

This case serves as a significant example of how AI tools can unintentionally lead to serious errors in legal proceedings. Greaves took full responsibility for the inaccuracies, asserting, "As the supervising partner, and the signer of the pleading, the responsibility for having accurate citations is entirely on me. I take full responsibility for that and apologize fully to the court and to all counsel in this case for the phantom quotations that appeared in the motion. I have also personally apologized to the Plaintiffs’ attorneys."
